The Failure of the WIPO Audiovisual Performances Treaty

Performances of film actors have never been protected internationally. Already in 1961 they were, at American insistence, excluded from the protection all other kinds of performers obtained in the Rome Convention. With the WIPO Performances and Phonograms Treaty of 1996 exactly the same occurred. But a resolution was now adopted in which this outcome "in spite of the efforts of most Delegations, was regretted" and a Protocol to the WPPT was requested to amend the deplorable situation. Four years later, in December 2000, a Diplomatic Conference was convened to conclude such a Protocol or Treaty to finally protect audiovisual performers. It failed.


Darbietungen von Filmschauspielern wurden international nie geschützt. Auf amerikanisches Drängen wurden sie bereits 1961 vom Schutz, welchen alle anderen darstellenden Künstler im Rom-Abkommen erlangten, ausgeschlossen. Genau das Gleiche geschah im 1996 verabschiedeten WIPO Performances and Phonograms Treaty (WPPT). Immerhin wurde eine Resolution angenommen, in welcher dieses "trotz den Anstrengungen der meisten Delegationen zustande gekommene Ergebnis bedauert" wurde, und ein Protokoll zum WPPT gefordert wurde, um die bedauerliche Situation zu verbessern. Vier Jahre später, im Dezember 2000, versammelte sich eine Diplomatische Konferenz, um ein solches Protokoll oder einen Vertrag zum Schutze der darstellenden Künstler zu verabschieden. Les prestations des acteurs de cinéma n'ont jamais été protégées sur le plan international. Sous la pression des Etats-Unis, elles ont été exclues en 1961 déjà de la protection dont bénéficiaient tous les autres artistes interprètes dans le cadre de la Convention de Rome. Le phénomène identique s'est produit lors de l'adoption, en 1996, du Traité de l'OMPI sur les interprétations et exécutions et les phonogrammes (WPPT). Cependant, une résolution a été adoptée, aux termes de laquelle "on a déploré le résultat obtenu, malgré les efforts de la plupart des délégations", et soutenu la création d'un protocole au WPPT, afin d'améliorer cette situation.
